The article analyses, in a comparative perspective, the phenomenon of the evolution of the protection of surviving spouse’s inheritance rights in France and Lithuania, the two legal systems historically having some points of interaction. The protection of the surviving spouse is one of the major preoccupations of married couples of today, the couple occupying a central role within the contemporary family. Comparative analysis reveals certain points of convergence between these two legal systems inasmuch the surviving spouse is considered by both (...) legislations as an heir ab intestat and whose protection over the years has been considerably strengthened. The surviving spouse is called to inherit alongside with the heirs of the first or second order and is entitled to the proportions in assets that have not ceased to increase. Lithuanian law seems to have been innovative at an earlier stage than French law, as it is only in the beginning of the 21st century that significant reforms were carried out in this area of law in France. Analysis has also revealed apparent differences in the scope of protection of the surviving spouse, both in regards to the protection provided by law (statutory protection), as well as protection organised by the will of the spouses (voluntary protection). In some respects the statutory protection is more extensive in France (for example, complementary statutory rights of the spouse in regards to the dwelling place or the quality of héritier réservataire) and the instruments of this protection seem to be more varied (for example, the possibility for the spouses to organise their matrimonial regime by inserting specific clauses into the nuptial contract, mechanisms outside the nuptial contracts, such as donations, wills or life insurance contracts). However, this protection might appear to be more extensive under Lithuanian law as far as the voluntary protection is concerned taking into account the introduction, by the new Lithuanian Civil Code of 2000, of the joint will of spouses under which the whole property of the deceased spouse shall be inherited by the surviving spouse (except the mandatory share of succession). The article raises some doubts as to the desirability or even feasibility of aligning the two models of protection given the fact that each of the two countries has its own history and traditions. Nevertheless, a proposition resurges from the analysis in regard to the possible improvement of the protection of the rights to the dwelling place of the surviving spouse under Lithuanian law. Some elements from the existing French model could be transposed given that the dwelling place is an essential family element providing some stability for the surviving spouse. (shrink)

La métaphore du réseau s'est imposée durant les années quatre vingt dix à l'occasion de ce qu'il est convenu d'appeler le « topical turn », pour décrire les logiques de développement de la vie culturelle et leur analyse en termes spatiaux plutôt que temporels. Simultanément, il arrive que la constitution de réseaux soit bel et bien déterminée historiquement notamment de manière générationnelle ou sociopolitique. Les contributeurs de cet ouvrage s'inspirent de cette réflexion pour traiter d'un phénomène de réverbération dans l'histoire (...) culturelle, en particulier d'expression allemande, des années vingt aux années soixante du XXe siècle. Au plan métacritique, la réception répétée de la philosophie de Frédéric Nietzsche, mais aussi d'Ernst Cassirer notamment chez Michel Foucault et Gilles Deleuze apparaît comme un lien constitutif de ce déploiement métaphorique. D'autres modèles explicatifs sont présentés tel celui des paradigmes en science ou celui d'un équilibrage pulsionnel, de type psychanalytique. Des études de cas précis illustrent également cette hésitation entre le modèle métaphorique et le modèle historique, concernant les modes d'affirmation de certaines avants-gardes, l'étude de la reprise poétique chez Heissenbüttel ou Rühmkorf, filmique chez Godard, ou théâtrale chez les héritiers d'Artaud. Die Metapher des Netzwerkes hat sich im Laufe der neunziger Jahre anlässlich des sogenannten «topical turn» zur Beschreibung der logischen Mechanismen in der Entwicklung des kulturellen Lebens und deren Analyse in eher räumlichen als zeitlichen Begriffen durchgesetzt. Der Aufbau von Netzwerken mag aber auch historisch bedingt sein, zum Beispiel durch Generationszugehörigkeit und sozial-politische Umstsozial-politische Umstände. Die Beiträger dieses Bandes gehen von dieser Überlegung aus, um sich dem Phänomen der Spiegelung in der Kulturgeschichte - insbesondere in der deutschsprachigen - von den zwanziger bis sechziger Jahren des 20. Jahrhunderts auseinanderzusetzen. Auf metakritischer Ebene erscheint die wiederholte Rezeption der Philosophie Friedrich Nietzsches, aber auch Ernst Cassirers, insbesondere bei Michel Foucault und Gilles Deleuze als eine Verbindung, die wesentlich ist für die Entfaltung der räumlichen Metaphorik. Weitere Erklärungsmodelle werden vorgeschlagen, wie das paradigmatisch-wissenschaftliche oder das triebhaft-psychoanalytische. This Element has two aims. The first is to discuss arguments philosophers have made about the difference God's existence might make to questions of general interest in metaethics. The second is to argue that it is a mistake to think we can get very far in answering these questions by assuming a thin conception of God, and to suggest that exploring the implications of thick theisms for metaethics would be more fruitful.

Across 13 essays "e; 12 of which were previously unavailable in English "e; Deleuze specialist Anne Sauvagnargues reveals the continuing potential of Deleuze, Guattari and Simondon to invent new concepts and new modes of creativity and existence. She redeploys their work, together with other key philosophers including Bergson, Lacan, Deligny and Ruyer, to create new concepts including geophilosophy, the artmachine, the ritornello, schizoanalysis and the machinic assemblage.

Studies in the behavioral ethics and moral psychology traditions have begun to reveal the important roles of self-related processes that underlie moral behavior. Unfortunately, this research has resulted in two distinct and opposing streams of findings that are usually referred to as moral consistency and moral compensation. Moral consistency research shows that a salient self-concept as a moral person promotes moral behavior. Conversely, moral compensation research reveals that a salient self-concept as an immoral person promotes moral behavior. This study’s aim (...) was to integrate these two literatures. We argued that compensation forms a reactive, “damage control” response in social situations, whereas consistency derives from a more proactive approach to reputation building and maintenance. Two experiments supported this prediction in showing that cognitive depletion (i.e., resulting in a reactive approach) results in moral compensation whereas consistency results when cognitive resources are available (i.e., resulting in a proactive approach). Experiment 2 revealed that these processes originate from reputational (rather than moral) considerations by showing that they emerge only under conditions of accountability. It can thus be concluded that reputational concerns are important for both moral compensation and moral consistency processes, and that which of these two prevails depends on the perspective that people take: a reactive or a proactive approach. The standard view of ignorance is that it consists in the mere lack of knowledge or true belief. Duncan Pritchard has recently argued, against the standard view, that ignorance is the lack of knowledge/true belief that is due to an improper inquiry. I shall call, Pritchard’s alternative account the Normative Account. The purpose of this article is to strengthen the Normative Account by providing an independent vargument supporting it.

In this paper I will present three reservations about the claims made by Hutto and Satnet. First of all, though TNOC is presented as drawing on teleological theories of mental content for a conception of Ur-Intentionaltiy, what is separated out after objectionable claims are removed from teleological accounts may not retain enough to give us directed intelligence. This problem raises a question about what we need in a naturalistic basis for an account of the mental. Secondly, I think that the (...) authors’ objections to cognitive science’s supposed notion of a mental representation in fact attack a philosophers’ invention, one that sprung into vibrant being in the mid-1970’s. It is not employed in cognitive neuroscience to any significant extent and it isn’t needed by other disciplines involved in cognitive science. Finally, I worry that the account of the origin of content – namely, explanatory narrative - presents us with a too limited view of human discourse, particularly as it is needed for a social theory of mind. Is causation either necessary or sufficient (or both) to make a belief-desire pair the reason for which one acts? In this paper I argue in support of a negative answer to this question, and thus attempt to shift the burden of proof onto the causal theorists. I also provide an outline of a different account of reasons and rationalization. Motivating my inquiry is a concern to show that ordinary ascriptions of reasons are not hostage to future accounts of how the (...) brain works. (shrink)

This article explores emerging ethical questions that result from knowledge development in a complex, technological age. Nursing practice is at a critical ideological and ethical precipice where decision-making is enhanced and burdened by new ways of knowing that include artificial intelligence, algorithms, Big Data, genetics and genomics, neuroscience, and technological innovation. On the positive side is the new understanding provided by large data sets; the quick and efficient reduction of data into useable pieces; the replacement of redundant human tasks by (...) machines, error reduction, pattern recognition, and so forth. However, these innovations require skepticism and critique from a profession whose mission is to care for and protect patients. The promise of technology and the new biological sciences to radically and positively transform healthcare may seem compelling when couched in terms of safety, efficiency, and effectiveness but their role in the provision of ethical nursing care remains uncertain. Given the profound moral and clinical implications of how today’s knowledge is developed and utilized, it is time to reconsider the relationship between ethics and knowledge development in this new uncharted area. The nineteenth-century museum and auction house are seemingly distinct spaces with opposing functions: while the former represents a contemplative space that accumulates objects of art and science, the latter provides a forum for lively sales events that disperse wares to the highest bidders. This contribution blurs the border between museums and marketplaces by studying the Berlin Zoological Museum's duplicate specimen auctions between 1818 and the 1840s. It attends to the operations and tools involved in commodifying specimens as duplicates, particularly the (...) auction catalogue. The paper furthermore contextualizes the museum's sales in a broader history of duplicate auctions across Berlin's collection landscape. (shrink)

From a post-structuralist position, it is problematic and seemingly impossible to refer to God as the Trinity. This article describes possibilities for thinking about the Trinity (religion and God) within a post-structuralist context. As an example of such thinking, the 2015 culture-critique film, The Brand New Testament, will be analysed. It is a creative retelling of the Christian story and of the Trinity in a secular and post-metaphysical vein. This ‘Brand New Testament’ reveals God as ‘one’ – as the encompassing (...) love, hope and life which we may experience in this life. The life-giving characteristics of this ‘god’ are surprisingly close to the biblical understanding of the Trinity. In the ‘Brand New Testament’, however, the Trinity is portrayed radically differently than in the Christian tradition. The personae of father, son and spirit are deconstructed in the film, in that a daughter and a mother also form part of the godhead. This deconstruction of the Trinity, which should not be confused with blasphemy, opens up a possible post-structuralist imagining of God. It playfully reveals a powerless god who shares some fundamental characteristics with the Trinity – such as love, joy and life. It allows for the ‘oneness of god’ to include more, and less, than the ‘Holy Trinity’. (shrink)

ABSTRACTAccumulating evidence suggests that emotional information is often recognised faster than neutral information. Several studies examined the effects of valence and arousal on word recognition, but yielded partially diverging results. Here, we used two alternative versions of a constructive recognition paradigm in which a target word is hidden by a visual mask that gradually disappears, to investigate whether the emotional properties of words influence their speed of recognition. Participants were instructed either to classify the incrementally appearing word as emotional or (...) non-emotional or to decide whether the appearing letter string is an existing word or not. Results from both tasks revealed faster recognition times for high- compared to low-arousing words, and for positive compared to negative or neutral words. Social media platforms have been vested with hope for their potential to enable ‘ordinary citizens’ to make their judgments public and contribute to pluralized discussions about organizations and their perceived legitimacy :60–97, 2018). This raises questions about how ordinary citizens make judgements and voice them in online spaces. This paper addresses these questions by examining how Western citizens ascribe responsibility and action in relation to corporate misconduct. Empirically, it focuses on modern slavery and analyses online debates in Denmark on child (...) slavery in the cocoa industry. Conceptually, it introduces the notion of cosmopolitanism as a general disposition of care and responsibility towards distant others, conceived as a prerequisite for the critical evaluation of corporate responsibility in the Global South. The analysis of online debates shows that citizens debate child slavery in terms of individual consumer responsibility rather than corporate responsibility. Corporations are not considered potential agents of change. As a consequence, online citizen debates did not reflect a legitimacy crisis for the cocoa industry, as debates over responsibility were overwhelmingly concerned with the agency of the Western individual, the individual agency of the speakers themselves. The purpose of this study was to identify and describe published research articles that were named in official findings of scientific misconduct and to investigate compliance with the administrative actions contained in these reports for corrections and retractions, as represented in PubMed. Between 1993 and 2001, 102 articles were named in either the NIH Guide for Grants and Contracts (“Findings of Scientific Misconduct”) or the U.S. Office of Research Integrity annual reports as needing retraction or correction. In 2002, 98 of (...) the 102 articles were indexed in PubMed. Eighty-five of these 98 articles had indexed corrections: 47 were retracted; 26 had an erratum; 12 had a correction described in the “comment” field. Thirteen had no correction, but 10 were linked to the NIH Guide “Findings of Scientific Misconduct”, leaving only 3 articles with no indication of any sort of problem. As of May 2005, there were 5,393 citations to the 102 articles, with a median of 26 citations per article (range 0–592). Researchers should be alert to “Comments” linked to the NIH Guide as these are open access, and the “Findings of Scientific Misconduct’ reports are often more informative than the statements about the retraction or correction found in the journals. Every epistemological theory needs to be able to articulate some version of the following principle: If S's belief "q" is to make S's belief "p" justified (or is to make "p" something S knows), then "q" must possess some positive epistemic merit. This paper argues that naturalizing epistemologies do not have access to this principle. The central problem is that of providing a naturalistic account of the notion of a reason-for-which one believes while avoiding internalist commitments. Character strengths research has the potential to imply that youth have character deficits or moral failings that cause their problematic behavior. This ignores the impact of context, especially for youth who are members of historically marginalized groups in under resourced communities. On the other hand, framing youth who are members of underrepresented groups solely as products of oppression undermines their agency and the power of collective action. It may be possible to promote character development in a contextually relevant, culturally grounded (...) way through a transdisciplinary, participatory action approach. We engaged in this work in three phases: goal specification; logic model identification; and intervention development and testing. Lessons learned included the need for intensive trust-building and identifying the limitations in scope and capacity. Overall, a transdisciplinary, participatory action approach is a promising strategy to overcome the existing bias in virtue development research and to leverage positive psychology to address health disparities. Sigmund Freud’s five long case histories have been the focus of seemingly endless fascination and criticism. This article examines how the long case-history genre developed and its impact on the professionalization of psychoanalysis. It argues that the long case histories, using a distinctive form that highlighted the peculiarities of psychoanalytic theory, served as exemplars in the discipline. In doing so, the article extends John Forrester’s work on ‘thinking in cases’ to show the practical implications of that style of reasoning. The (...) article illustrates how the form disappeared once the theoretical basis of the movement was set. The genre never became institutionalized, although the content of the five long case histories did, because of Freud’s accepted role as theoretician of psychoanalysis. (shrink)

Lyotard's notion of the differend can be analysed as a philosophical theory of radical disputes, that is, disputes with no possible resolution other than the silencing of one of the parties. The concept is explicitly meant to shed light on ethical, historical and political debates, while literature and psychoanalysis are strikingly absent from this theory. However, the concept of the differend is crucial to Lyotard's own discussions of literature and art. Developing from a reading of some of his texts on (...) literature and art and on psychoanalysis, this essay shows how the concept of the differend operates in Lyotard's understanding and appreciation of literature and art, in order to then ask how the differend can help us think issues of ‘modernity’, ‘modernism’ and ‘postmodernism’ in terms other than those of literary history, and can help us think experimental writings and artistic practices of the twentieth century in terms other than those of provocation or scandal. It is postulated from different philosophical traditions, and explicitly in recent literature, that there is no further need for doing philosophy of religion – it has become an impossible task. I argue, however, that there remains a philosophical space for this practice and that this space determines greatly how philosophy of religion can be done. The starting point of my argument is the current discussion in the SAJP between De Wet and Giddy and the significance of my article is that (...) it puts this debate within the broader international philosophical context by engaging the work of Trakakis and Desmond to resolve some of the apparently intractable issues raised. Trakakis discusses the divide between the analytic and continental philosophical traditions in which De Wet and Giddy’s work is further contextualized and clarified. Desmond’s work is seminal in its search for a metaxology wherein he advocates a new ‘in between’ position for doing philosophy of religion. I take this view of Desmond further by applying it to the current debate in South Africa and also using it to indicate some possibilities of speaking about the impossible. (shrink)

This article examines various meanings of solitude in eighteenth-century Europe, with emphasis on French thought and culture. Part 1 is a survey of literary representations of solitude and contemplation. Part II is devoted to the Jansenist convulsionnaires, Catholic dissidents who took part in a larger appeal against the repressive Unigenitus Bull of 1713. Although the convulsionary movement sought to attract crowds and publicity, it was also grounded in a Jansenist tradition of spiritual retreat that was emulated by the movement’s de (...) facto patron saint, the appellant deacon François de Pâris. Part III features writings by Zimmermann and Tissot, who medicalized solitude for three reasons: belief in the ethos of sociability, concern over the pathogenic powers of the imagination, and suspicion towards the passions that drove some people to fix their minds exclusively on certain ideas. To show solitude’s harmful consequences for those who spent too much time absorbed in ideas, they made intriguing connections between secular knowledge-seekers and the religiously devout. The Jansenist convulsionnaires were one of the dangerously zealous groups whom they cited to illustrate their arguments. (shrink)

This paper explores the notion of practical wisdom asan alternative to current formulations of criticalthinking. The practical realm is that ofill-structured problems that emerge from life aslived; it is a realm of legitimate uncertainty andambiguity that requires an ethical responsiveness orpractical wisdom. The death of a child is a case inpoint. The author identifies and examines threeaspects of practical wisdom – the ethical claims ofpartiality, a yielding responsiveness and the play ofthought – and juxtaposes them with aspects of criticalthinking. The (...) work of Martha Nussbaum and RichardPaul are interwoven throughout the discussion. Theauthor concludes that the discourse of criticalthinking is in danger of lapsing into a form of moralescapism wherein all we are rationally responsible foris thinking correctly. Practical wisdom, on theother hand, recognizes that thinking is not simply anintellectual cognitive act of an individual but adance between the life of a child and the love of anelder, a conversation between what is and what couldbe, an openness to passionate sorrow and surprise, aplay between understanding and perception. As such,practical wisdom provides a more likely account ofliving in good faith with oneself and others. (shrink)

Reading and writing are increasingly performed with digital, screen-based technologies rather than with analogue technologies such as paper and pen. The current digitization is an occasion to “unpack,” theoretically and conceptually, what is entailed in reading and writing as embodied, multisensory processes involving audiovisual and ergonomic interaction with devices having particular affordances. Highlighting the sensorimotor contingencies of substrates and technologies — how movement and object manipulation affect perception, experience, and sensory “feel” — this article presents an embodied approach to reading, (...) writing, and literacy, using three cases of digitization as illustrations of some educational implications: beginning writing by hand or by keyboard; dialogic reading with iPads and print picture books in kindergarten; and deep reading of long, linear texts on paper and on screens. The purpose of this article is to encourage and help inform active discussion of authorship policies among members of scientific societies. The article explains the history and rationale of the influential criteria for authorship developed by the International Committee of Medical Journal Editors, examines questions about those criteria that emerge from authorship policies adopted by several U.S. medical schools, and summarizes the arguments for replacing authorship with the contributorguarantor model. Finally, it concludes with a plea for scientific societies to play (...) a prominent role in the ongoing debates about authorship and the alternatives as part of their efforts to encourage ethical conduct among their members. Whether or not scientific societies develop authorship policies of their own, they should undertake vigorous educational efforts to keep their new members adequately informed about the importance of authorship practices in ethical scientific research and publication. Nous pensons que conjugalité et parentalité étant intrinsèquement liées, leur liaison doit être remaniée lors de séparation et/ou de recomposition. There has been a focus on policies relating to early years education and care across the developed world and particularly in Europe. In the UK, there has been a raft of policy changes alongside increased investment. However, this paper argues that these changes may not be sufficient to meet EU objectives in terms of quality or the government's policy goals of high quality, affordable and accessible early years education and care. There are major issues that appear to militate against achieving (...) these goals; these relate to the levels of government funding and to the regulatory context. There are also divergences between the providers in terms of their own objectives and underlying values which mean that quality may be variable and access to certain types of providers restricted. These factors appear to militate against the delivery of universal provision of high quality early years education and care. (shrink)

This paper focuses on the reforms made to the quasi-market in school-based education in England that occurred between May 1997 and May 2001. It discusses the changes that have taken place in relation to parental choice, admissions to schools, school diversity, funding and examination 'league tables'. The Labour Government can be seen as having embraced the quasi-market with a similar enthusiasm to that of its Conservative predecessors although it has tended to emphasise social inclusion as opposed to competition. In robotics research with language-based interaction, simplifications are made, such that a given event can be described in a unique manner, where there is a direct mapping between event representations and sentences that can describe these events. However, common experience tells us that the same physical event can be described in multiple ways, depending on the perspective of the speaker. The current research develops methods for representing events from multiple perspectives, and for choosing the perspective that will be used for (...) generating a linguistic construal, based on attentional processes in the system. The multiple perspectives are based on the principle that events can be considered in terms of the force driving the event, and the result obtained from the event, based on the theory of Gärdenfors. In addition, within these perspectives a further refinement can be made with respect to the agent, object, and recipient perspectives. We develop a system for generating appropriate construals of meaning, and demonstrate how this can be used in a realistic dialogic interaction between a behaving robot and a human interlocutor.
